What are the new Smoke and Carbon Monoxide Alarm regulations?
Regulations around Smoke and Carbon Monoxide Alarms have come into force on the 1st of October 2022. These have big implications for landlords and those that run residential settings and environments. The Smoke and Carbon Monoxide Alarm Amendment 2022 states that:
- At least one BS EN 14604 compliant Smoke Alarm must be installed on every storey of the property that has rooms that are used for living accommodation.
- One BS EN 50291-1 compliant Carbon Monoxide Alarm must be installed in any room that is used as living accommodation that contains a fixed combustion appliance (excluding gas cookers – although CO Alarms being installed in this case is still highly recommended)
What do the regulation changes mean for landlords?
Under the new regulations many landlords may need to install more Smoke and Carbon Monoxide Alarms in their properties, or arrange to have these installed. However, a landlord’s responsibility does not stop at installation, as they are also responsible for repair any issues or problems and replacing any faulty alarm parts or equipment, as soon as this is brought to their attention by the tenant. Landlords must also ensure that the Smoke and CO Alarms are functioning correctly before the start of each new tenancy.
If landlords are found to not be complying with these new regulations, they will be served with a remedial notice, and if action is still not taken, fines of up to £5,000 will be issued.
